• For the purposes of this section, Personal Information will be understood in accordance with the definition provided in the Protection of Personal Information Act 4 of 2013 (“the Act”). uBuyaBox also subscribes to the principles for electronically collecting Personal Information outlined in the Act, and the further legislation referred to therein. We endeavour to ensure the quality, accuracy and confidentiality of Personal Information in our possession.
• In adopting this Privacy Policy, we wish to balance our legitimate business interests and your reasonable expectation of privacy. Accordingly, we will take all reasonable steps to prevent unauthorized access to, or disclosure of your Personal Information to third parties, save for what is set out in clause 4 However, it is impossible to guarantee that your Personal Information shall be 100% secure.  
• When making use of the Website, users may be asked to provide, but not being limited to, the following information (Personal Information):
• First name;
• Surname;
• Email;
• Physical address;
• Phone number;
• Company / CC / business name; and
• Postal address

• By agreeing to the terms contained in this Privacy Policy, you consent to the use of your Personal Information in relation to:

• To provide the Vendor with communication updates; and

Such information will be compiled and retained in aggregated form, but shall not be used in any way which may comprise the identity of a user.
• Although absolute security cannot be guaranteed on the internet, uBuyaBox has in place up-to-date, reasonable technical and organisational security measures to protect your Personal Information against accidental or intentional manipulation, loss, misuse, destruction or against unauthorised disclosure or access to the information we process online.
• While we cannot ensure or warrant the security of any Personal Information you provide us, we will continue to maintain and improve these security measures over time in line with legal and technological developments.
• We store your Personal Information directly, or alternatively, store your Personal Information on, and transfer your Personal Information to, a central database. If the location of the central database is located in a country that does not have substantially similar laws which provide for the protection of Personal Information, we will take the necessary steps to ensure that your Personal Information is adequately protected in that jurisdiction.
• Your information will not be stored for longer than is necessary for the purposes described in these Terms or as required by applicable legislation.
• The Personal Information uBuyaBox collects from users shall only be accessed by uBuyaBox employees, representatives and consultants on a need-to-know basis, third parties as set out in clause 4 below, and subject to reasonable confidentiality obligations binding such persons. 
• uBuyaBox shall have the right, but shall not be obliged, to monitor or examine any information and materials including any website link that you publish or submit to uBuyaBox for publishing on the Website.  You shall be solely responsible for the contents of all material published by yourself.
• We constantly review our systems and data to ensure the best possible service to our users. We do not accept any users, or representatives of users, under 18 years of age or who otherwise does not have the relevant capacity to be bound by this Privacy Policy.
• Save for what is set out in clause 4 below, we will not sell, share, or rent your Personal Information to any third party or use your e-mail address for unsolicited mail. Any emails sent by uBuyaBox will only be in connection with the provision of the Services and Products and/or the marketing thereof. 

      2. Security of Your Personal Information

• uBuyaBox will make every effort to safely secure and store Personal Information collected, by implementing up-to-date, reasonable technical and organisational security measures, including:
• Restricting access to Personal Information to those who need to know.
• Maintaining technology products to prevent unauthorised computer access and security vulnerabilities.
• Securely destroying your Personal Information when it’s no longer needed for our record retention purposes.
• All passwords are stored using a one-way SHA-512 hashed encryption mechanism; and
• Using a 256 – bit SSL (secure sockets layer) encryption technology when processing your Personal Information. SSL encryption is the industry standard.

      3. Disclosure of Personal Information

• Your Personal Information may be shared with third parties as described below:
• Contracted and Trusted Third Parties: Subject to entering into operator or data processing agreements, we may employ other companies and people to perform tasks on our behalf and need to share your Personal Information with them to provide Services or Products to you. Unless we tell you differently, such third parties do not have any right to use the Personal Information we share with them beyond what is necessary to assist us. This includes third party companies and individuals employed by us to facilitate our services, including the provision of maintenance services, database management, Web analytics and general improvement of the Services.
• uBuyaBox currently uses Google Analytics as a trusted third party and may use other trusted third parties in the future.
• Business to Business: We may choose to co-brand or do a joint venture or buy or sell, among other things. In these instances, confidential information regarding the business may include Personal Information which can be transferred, sold or bought. Whether it is an acquisition, or if the business is dissolved, enters bankruptcy, or goes through some other change of control, Personal Information could be part of the transfer or acquired by a third party.
• Protection of uBuyaBox and others: The right is reserved by us to access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with law or a court order; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of uBuyaBox, our employees, our users, or others. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction, which may include Personal Information.
• On Consent: Except as set out above, a notification will be sent to you when your Personal Information may be shared with third parties, and will be able to prevent the sharing of this information.
• With Vendors: Personal Information may be shared with Vendors when purchasing goods on the Site.

• Your personal information may be update at anytime by accessing your Account Profile on uBuyaBox’s website.

     8. Application Of The Electronic Communications And Transactions Act 25 of 2002 ("ECT Act")

• Data Messages (as defined in the ECT Act) will be deemed to have been received by uBuyaBox if and when uBuyaBox responds to the Data Messages.
• Data Messages sent by uBuyaBox to a user will be deemed to have been received by such user in terms of the provisions specified in section 23(b) of the ECT Act.
• Users acknowledge that electronic signatures, encryption and/or authentication are not required for valid electronic communications between users and uBuyaBox.
• Information to be provided in terms of section 43(1) of the ECT Act:
• Users warrant that Data Messages sent to uBuyaBox from any electronic device, used by such user, from time to time or owned by such user, were sent and or authorised by such user, personally.
